Prices/Base Currency

All fees and prices are in Pakistani Rupees (PKR). You might see prices/fees in your local currency based on standard currency exchange.

Changing of Prices

Site prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer or sales. Prices of items that are not in stock or that are available for a pre-order are valid during its promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the Site from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

Typographical Errors

We strive for accuracy in all item’s descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our Site. Due to human error and other determinates, we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed are entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labelled with an incorrect price due to some typographical, informational, technical or other error, we shall at our own sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Orders/Placing an Order

Placing an order can be done from the Site. Should you place the order from the Site, you have to be sure that personal data is correct and updated. We suggest Customers to proof-read the order form several times before validating the order. We are neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled-out.

Promotional, Deals, Sale, Discount and Selling with Super low-price Products standard sales Policy

• Sale products with a high/huge cut-down price cannot be purchased by any AIIT Solutions & immediate family members.
• The management retains the right to reject any orders that has been tampered with or found in any way unacceptable.
• Promotions run while quantities lasts.
• Management will suspend any orders that is suspected to have made by any employee for their own purpose and strict action will be taken against any fraud & ill intentions.

Order Processing Time

You can expect your order to be processed within approximately 48-72 hours, provided the items are in stock and there are no problems with payment verification. We do not guarantee the same day shipping. Orders are not processed on weekends and holidays.

Order Acceptance Policy

Your receipt of electronic or other forms of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right, at any time after receipt of your order, to accept or decline your order for any reason. We reserve the right, at any time after receipt of your order, to supply less than the quantity you ordered of any item without prior notice to you. Invoice

The order form filled out online by the Customer cannot be considered as an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital copy of each invoice is registered in our secure and encrypted database.

Suspension, Termination, Cancellation

Without prejudice to any of our rights and remedies as provided in these Terms and Conditions including laws, rules, regulations, including other terms, conditions or any policies as we may impose from time to time, we have the right to unilaterally and immediately suspend, limit, withdraw, revoke or terminate your access to our Megatechmall.com Site and Mobile Application and/or Megatechmall.com Services upon the occurrence of any of the following:

• breach of any provision of these Terms and Conditions in any manner whatsoever;
• breach of any laws, rules, regulations including other terms, conditions or any policies as we may impose from time to time for the use and access of the Warsak Site and Mobile Application and Megatechmall.com Services;
• you fail to reasonably cooperate with our investigation;
• we reasonably believe that your continued provision of our Store Services would expose you or us or our affiliates (including third-party providers) to a material security or regulatory action; or
• any other events as provided in these Terms and Conditions or any of our policies as we may amend from time to time.

You agree that we will not be liable for any claim or compensation directly or indirectly whatsoever to you or to any other person as a result of your suspension or termination of your access and use of the megatechmall.com Site and Mobile Application.

We reserve our right to take appropriate action if you are suspected of acting fraudulently or if you file invalid and/or false claims or provide false, incomplete, or misleading information. You may be considered to be engaging in fraudulent activities if any of the following (without limitation) are met:

• you don’t reply to the payment verification mail sent by us;
• you fail to produce adequate documents during the payment details verification;
• you misuse credentials not belonging to you;
• you use invalid address, email and phone no;
• you attempt to overuse a voucher code;
• you return wrong or damaged product;
• you refuse to pay for an order;
• for Cash-on-Demand (COD) items, you use fake currency notes to make the payment;
• you abuse or harass the delivery staff;
• miscellaneous activities conducted with the sole intention to cause loss to business/revenue to noon;
• your return, undeliverable rate is very high and often the returned products are missing, fake or damaged; or
• Repeated request for monetary compensation.

For the avoidance of doubt, any amounts paid and received by us in relation to a cancelled product(s) order will be refunded.

Security

We will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to the information you may provide. Disputes

If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) (“Dispute”) arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute. The arbitration proceedings shall be conducted in the English language and the award shall be in English. The foregoing provisions of this clause are without prejudice to the right of Megatechmall.com to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and Megatechmall.com shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so.

If it is determined that you retain moral rights (including rights of attribution or integrity) in the content submitted by you, you hereby declare that: (a) you do not require that any personally-identifying information be used in connection with the content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of the content by us or our licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the content; (d) you forever release us, and our licensees, successors and assigns, from any claims that you could otherwise assert against us by virtue of any such moral rights. You also permit any other User to access, view, and store or reproduce the content for that Users personal use. We reserve the right to modify or delete your feedback if it contains the content against Megatechmall.com or its affiliated business partners. You also agree not to use any pseudo name or fake identity to post feedback. We will delete feedback from pseudo accounts and might take legal action against the feedback poster. Notwithstanding the foregoing, you acknowledge that your Feedback may contain concepts, ideas, materials, proposals, suggestions and the like relating to Site or its initiatives, (hereinafter your “Ideas.”) With respect to your Ideas you acknowledge that: (a) we receive numerous submissions from many parties and/or may have independently developed and/or considered ideas similar to your Ideas, and that our review of your Ideas is not an admission of novelty, priority or originality; (b) our use of any ideas similar to your Ideas, whether based on your Feedback or Submissions, provided to us by Third Parties or independently developed or considered by us, shall be without obligation to you.

Limitations of Liability

In All Circumstances Megatechmall.com’ s Maximum Liability Is Limited To The Purchase Price Of The Products Sold Megatechmall.com Shall Not, Under Any Circumstances, Be Liable Upon A Claim Or Action In Contract, Tort, Indemnity Or Contribution, Or Other Claims Relating To The Products It Sells Which Exceeds This Liability Limit. Megatechmall.com Shall Not Be Liable For Third Party Claims For Damages Against The Customer, Or For Malfunction, Delays, Interruption Of Service, Loss Of Business, Loss Or Damage To Exemplary Damages, Whether Or Not Megatechmall.com Has Been Made Aware Of The Possibility Of Such Claims Or Damages. If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to Megatechmall.com and we shall treat any such unauthorized use as subject to the Terms. Products deemed to be super-savers or highly discounted by the company might be limited by quantity per order and company reserve the right to alter ordered quantity for such products and or cancel the order with or without consent of the customer. We reserve the right to cancel any unpaid order under any circumstances without any owed liability towards the customer or otherwise, in-case of paid order we still reserve this right as long as paid amount is returned in full.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of Megatechmall.com or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site is the exclusive property of Megatechmall.com. We and our suppliers and licensors expressly reserve all intellectual property rights in all Content.

Governing Law

This User Agreement is governed by and construed in accordance with, Pakistani law. This clause will survive any expiry or cancellation of this User Agreement for any reason.
